1. Acceptance of Terms

By downloading, installing, or using RegionalCountdown ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the App.

These Terms constitute a legally binding agreement between you and RegionalCountdown.

2. Purpose of the App

RegionalCountdown is designed to help Working Holiday Visa holders (subclass 417 and 462) track their regional work for the purpose of:

• Recording work hours and dates
• Calculating estimated eligible visa days
• Generating reports for visa applications

3. Day Calculation Methodology

How We Calculate Days

RegionalCountdown calculates eligible visa days based on publicly available Australian Immigration rules as of October 2025. Our calculation methodology follows these principles:

Full-Time Workers (35+ hours per week)

• Rule: If you work 35 or more hours AND work 5 or more days in a calendar week, you can count the full 7-day week (including weekends).
• How we calculate:
  • We group your work entries by calendar week and employer
  • If total hours >= 35 AND unique work days >= 5 for that week, we count 7 days
  • Otherwise, we use the standard calculation (hours / 7)

Part-Time and Casual Workers

• Rule: Count only actual hours worked, using the standard workday calculation
• How we calculate:
  • Total hours worked / 7.0 (standard workday) = eligible days
  • No weekend counting benefit for part-time/casual work

Standard Workday

We use 7.0 hours as the standard workday, consistent with Australian Immigration guidelines.

Important Calculation Disclaimers

You must understand that:

1. Official Rules May Change: Australian Immigration rules can change at any time. We strive to keep our calculations current, but we cannot guarantee they reflect the latest official requirements.
2. Individual Circumstances Vary: Your specific situation may have unique factors that affect your eligibility. Only the Department of Home Affairs or a registered migration agent can assess your individual case.
3. We Cannot Verify Your Work: We rely entirely on the information you enter. We cannot verify:
   • Whether your work qualifies as "specified work"
   • Whether your employer or location is eligible
   • Whether you meet all visa requirements
   • The accuracy of hours or dates you enter
4. Interpretation May Differ: Immigration officials may interpret rules differently than our calculations. The final determination of your eligibility rests solely with the Department of Home Affairs.
5. No Guarantee of Accuracy: While we implement calculations based on published guidelines, we cannot guarantee:
   • Mathematical accuracy in all scenarios
   • Correct interpretation of complex work patterns
   • Compatibility with future rule changes
   • That our calculations match official assessments

4. User Responsibilities

By using RegionalCountdown, you agree to:

1. Provide Accurate Information
   • Enter correct work dates, hours, and employer information
   • Update information if errors are discovered
   • Not manipulate data to misrepresent your work history
2. Verify Eligibility
   • Confirm your work qualifies as "specified work" under visa requirements
   • Ensure your employer and work location meet eligibility criteria
   • Check that your visa type is eligible for extension
3. Keep Original Records
   • Maintain original payslips, employment contracts, and other documentation
   • Do not rely solely on the App as your only record-keeping system
   • Keep backup copies of all exported data
4. Use Responsibly
   • Use the App for personal tracking purposes only
   • Not attempt to circumvent security measures
   • Not misuse or abuse premium features
5. Comply with Laws
   • Comply with all Australian immigration laws and regulations
   • Ensure your work is legal and authorized
   • Report accurate information to immigration authorities

5. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

No Liability for Visa Outcomes

• We are NOT responsible if your visa application is denied, delayed, or rejected
• We are NOT liable for any immigration consequences resulting from use of the App
• We do NOT guarantee that using the App will result in visa approval

No Liability for Calculation Errors

• We are NOT responsible for any errors or inaccuracies in day calculations
• We do NOT guarantee that our calculations match official immigration assessments
• We are NOT liable for any consequences of relying on our calculations

No Liability for Data Loss

• While we implement backup features, we are NOT responsible for any data loss
• You are responsible for maintaining your own backup records
• We are NOT liable for any consequences of data corruption or loss

No Liability for Service Interruptions

• We do NOT guarantee uninterrupted or error-free service
• We may suspend or terminate the App at any time
• We are NOT liable for any losses due to service unavailability

General Limitation

We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

• Use or inability to use the App
• Reliance on information provided by the App
• Data breaches, unauthorized access, or technical failures
• Any other matter relating to the App

Your sole remedy for dissatisfaction with the App is to stop using it.

6. Premium Features and Subscriptions

AI Payslip Scanning

• Premium feature that uses AI to extract information from payslip images
• Extracts estimated information only; you MUST verify all extracted data
• No guarantee of accuracy; OCR and AI can make mistakes
• Payslip images are automatically deleted after 24 hours

Subscription Terms

• Subscriptions are managed through Apple's App Store
• Pricing is displayed at the time of purchase
• Subscriptions auto-renew unless canceled at least 24 hours before renewal
• Cancel anytime through your Apple App Store account settings
• No refunds for partial subscription periods

Referral Program

• Earn premium credits by referring friends
• Credits can be used for payslip scans
• Credits are non-transferable and have no cash value
• We reserve the right to modify or terminate the referral program

Free Trial (if applicable)

• Free trials are subject to Apple's terms
• Unused trial periods are forfeited upon subscription purchase
• You must cancel before the trial ends to avoid charges

7. Acceptable Use Policy

You agree NOT to:

1. Misuse the App
   • Use for any illegal purpose
   • Attempt to circumvent security or premium features
   • Create fake accounts or manipulate referral systems
   • Share account credentials with others
2. Interfere with Service
   • Attempt to hack, disrupt, or damage the App
   • Use automated tools to access the App
   • Overload or interfere with our servers
3. Violate Rights
   • Infringe on our intellectual property
   • Reverse engineer or decompile the App
   • Remove copyright or proprietary notices
4. Misrepresent
   • Present the App as official immigration software
   • Claim the App provides legal or immigration advice
   • Use our name or branding without permission

Violation of this policy may result in account termination without refund.

8. Data Accuracy and Verification

Your Input Data

• You are solely responsible for the accuracy of data you enter
• We do not verify the information you provide
• Garbage in, garbage out: inaccurate input = inaccurate output

Exported Data

• CSV exports are based solely on data you entered
• Exports are for your personal records and convenience
• Exported data is NOT official documentation for visa applications
• Always verify exported data before submitting to immigration authorities

Payslip Scanning

• AI extraction is an estimate and convenience feature only
• You MUST review and verify all extracted information
• Common extraction errors include:
  • Misreading numbers or dates
  • Confusing similar text fields
  • Missing information from complex payslip layouts
• We are NOT liable for extraction errors

9. Intellectual Property

RegionalCountdown and all related content, features, and functionality are owned by us and are protected by:

• Copyright
• Trademark
• Patent
• Trade secret
• Other intellectual property laws

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

10. Account Termination

By You

• You may delete your account at any time through Settings
• Deletion is permanent and cannot be undone
• Local data will remain on your device after account deletion

By Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms and Conditions
• You abuse premium features or the referral system
• Your account is inactive for an extended period
• We discontinue the service

Effect of Termination

• You lose access to cloud-synced data
• Active subscriptions will continue until the end of the billing period
• No refunds for unused subscription time (per Apple's policy)

11. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

• We collect work entry data, account information, and usage data
• Payslip images are automatically deleted after 24 hours
• We use third-party services (Firebase, Claude AI)
• You have rights to access, export, and delete your data

12. Updates and Changes

App Updates

• We may update the App to add features, fix bugs, or improve performance
• Updates may be required to continue using the App
• We may discontinue features or the entire App at any time

Changes to Terms

• We may modify these Terms at any time
• Significant changes will be communicated via email or in-app notification
• Continued use after changes constitutes acceptance
• If you don't agree to changes, you must stop using the App

Changes to Calculation Methods

• We may update calculation methods to reflect new immigration rules
• Updates will be documented in release notes
• We are NOT responsible for retroactive recalculation of your data

13. Disclaimers and Warranties

We Disclaim All Warranties Including:

• Merchantability: No guarantee the App is suitable for your needs
• Fitness for Purpose: No guarantee the App will help you obtain a visa
• Accuracy: No guarantee of calculation accuracy
• Non-Infringement: No guarantee of uninterrupted operation
• Completeness: No guarantee the App includes all necessary features

No Immigration Advice

• We are NOT registered migration agents
• We do NOT provide legal or immigration advice
• Nothing in the App should be construed as professional advice
• Always consult qualified professionals for immigration matters

Third-Party Services

• We are NOT responsible for third-party services (Apple, Firebase, etc.)
• Their terms and policies apply to their services
• We disclaim liability for third-party failures or errors

14. Indemnification

You agree to indemnify, defend, and hold harmless RegionalCountdown, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Any information you submit through the App
• Any immigration consequences you experience

15. Governing Law and Disputes

Governing Law

These Terms are governed by the laws of Australia (or your local jurisdiction as applicable).

Dispute Resolution

If you have a dispute with us:

2. If unresolved, you may pursue legal remedies in accordance with applicable law
3. Any disputes will be resolved in the courts of competent jurisdiction

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits (to the extent permitted by law).

16. General Provisions

• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement.
• No Waiver: Our failure to enforce any right does not constitute a waiver.
• Assignment: You may not assign these Terms. We may assign without restriction.
